Both the California and U.S. Supreme Court has validated your right to video and audio record every interaction with police to include DUI checkpoints, any stop on the street, in a public establishment, or at a residence. Police cannot order you to stop recording nor can they confiscate your device (smartphone, tablet, etc) without an official warrant.
