This complaint filed against Colin Stewart, employed by the City of Santa Clara as a peace officer, is neither frivolous nor silly as there is certified documentation and witness testimony to support all claims.

Furthermore, this complaint is not without foundation. The City of Santa Clara and other peace officers admitted that Stewart did not wholly document use of force and that he appears to have broken departmental and county policies. Additionally, multiple first-hand witnesses concur that Stewart’s actions are not just violation of policy, he also violated California Penal Code to include omission of facts, embellishment of a police reports and false testimony while under oath.

Stewart has not been exonerated from the claims listed above or any of the actions listed in the original complaint filed on April 7, 2015.. A redacted version of that complaint can be found here: Complaint – Stewart – redacted

  1. Colin Stewart testified that the subject person never fought with police and never resisted. His only term was that the subject “turtled” on the ground after being tackled and forced to the concrete.
  2. Two police policies expert witnesses, Robert Fonzi and T.T. Williams, testified that the level of force used was excessive.
  3. Retired police sergeant who is a current academy instructor, Michael Yorks, recreated the scene and testified that Colin Stewart couldn’t have seen actions he wrote in his police report and testified to under oath.
  4. Colin Stewart testified that he has been trained as a Drug Recognition Expert, did not suspect the subject as being under the influence of narcotics, then petitioned the Santa Clara County Superior Court to keep from a jury drug lab results exonerating the person false claims of narcotics use.

As of May 2020, the City of Santa Clara has not found Stewart to be exonerated from any of the above allegation of policy violation or crimes.
